Instant petition under Section 482 Cr.P.C. has been preferred by the petitioners/applicants for quashing of the charge-sheet dated 12.12.2019 and cognizance order dated 08.07.2020 passed by the Judicial Magistrate, Kasia, Kushinagar as well as entire criminal proceedings of criminal case no. 2326 of 2020 (State vs. Hasina Khatoon and another) arising out of case crime no. 254 of 2017, under Sections 419 & 420 IPC, P.S.- Sevarahi, District Kushinagar, pending in the court of Judicial Magistrate, Kasia, Kushinagar.

After arguing at some length, learned counsel for the applicants/petitioners has submitted that he does not want to press the petition and seeks liberty to file bail application before the learned trial court which may be decided in view of law laid down by Hon'ble Supreme Court in order dated 7.10.2021 passed in Petition for Special Leave to Appeal (Cri) No.5191 of 2021 Satender Kumar Antil versus Central Bureau of Investigation and another.

Learned AGA has no objection to the prayer made by learned counsel for the petitioners.

On due consideration to the submissions of learned counsel for the parties', it is provided that in case, the applicants/petitioners move bail application before the trial court within fifteen days' from today, the same shall be decided within a period of ten days thereafter, in view of law laid down in the case of Satender Kumar Antil versus Central Bureau of Investigation and another (supra).

The petition is disposed of accordingly.
