Heard learned counsel for the applicants and learned A.G.A for the State.
By means of this Application under Section 482 Cr.P.C., the applicants have invoked the inherent jurisdiction of this Court for quashing of entire proceeding of Sessions Case No. 180 of 2022 (State Vs. Rajesh Kumar alias Raju and Another), arising out of Case Crime No. 11 of 2022, under Sections 323, 504, 324 IPC and 3(2)(va) and 3(1)(s) of SC/ST Act, Police Station Jaithara, District Etah, pending in the court of Special Judge (SC/ST) Act, Etah.
At the time of argument, learned counsel for the applicants submitted that a direction for bail may be granted.
Accordingly, the Application under Section 482 Cr.P.C. is disposed of with the direction to the trial court that if the applicants appear before the trial court within 15 days from today and apply for bail, their bail application shall be considered and decided, as expeditiously as possible, in view of law laid down in Satender Kumar Antil Vs. Central Bureau of Investigation and another, (2021) 10 SCC 773 and Brahm Singh and others Vs. State of U.P. and others, 2016 (95) ACC 950.
