By means of this Application under Section 482 Cr.P.C., the applicant has invoked the inherent jurisdiction of this Court for quashing of the further proceeding arising out of charge-sheet dated 16.12.2020 in Case Crime No. 0451 of 2020, under Sections 323, 504, 506, 507 IPC, Police Station Mughalsarai, District Chandauli and congnizance order dated 12.06.2021 passed by Chief Judicial Magistrate, Chandauli in Criminal Case No. 28193 of 2021 (State Vs. Sanjay Dubey), in Case Crime No. 0451 of 2020, under Sections 323, 504, 506, 507 IPC, Police Station Mughalsarai, District Chandauli, pending in the Court of Chief Judicial Magistrate, Chandauli.
At the time of argument, learned counsel for the applicant submitted that a direction for bail may be granted.
Accordingly, the Application under Section 482 Cr.P.C. is disposed of with the direction to the trial court that if the applicant appears before the trial court within a period of one month from today and apply for bail, his bail application shall be considered and decided, as expeditiously as possible, in view of law laid down in Satender Kumar Antil Vs. Central Bureau of Investigation and another, (2021) 10 SCC 773 and Brahm Singh and others Vs. State of U.P. and others, 2016 (95) ACC 950.
