By means of the present writ petition, the petitioners seek to challenge the recovery citation dated 11.01.2021 issued by the respondent No.5 for realization of the Mandi fees determined under Section 20 of the Uttar Pradesh Krishi Utpadan Mandi Adhiniyam, 1964. There is no challenge to the determination of the liability of the petitioner by the competent authority. Though, it is sought to be submitted by the learned counsel for the petitioner that under the relevant government order, the Mandi fees for certain period was liable to be exempted by the competent authority.
In absence of any challenge to the order, consequent to which recovery citation dated 11.01.2021 had been issued by the respondent No.5, no relief can be granted to the petitioner. It may further be noted that for the similar relief, a writ petition being Writ-C No.25277 of 2020 was earlier filed by the petitioner which was dismissed as not maintainable.
The writ petition is, accordingly, dismissed.
It is open for the petitioner to challenge the order passed under Section 20 of the Act' 1964 by filing a revision under Section 32 of the Act' 1964.
