In essence, the prayer made in the writ petition is to seek compliance of the order passed by the Debt Recovery Tribunal whereby, it had directed the Bank to pay interest as applicable on FDR to the auction purchaser, in order to protect the right of the auction purchaser, while allowing the securitization application filed by the borrower.
The appropriate cause of action for the petitioner is to approach the Debt Recovery Tribunal by moving an appropriate application.
At this stage, learned counsel for the petitioner prays for and is granted permission to withdraw the present writ petition with liberty to approach the Tribunal to raise her grievance.
The writ petition is, accordingly, dismissed as withdrawn.
