Heard learned counsel for the petitioners and learned Standing Counsel for the State.

The present writ petition has been filed alleging that the petitioners were allotted the lease of agricultural land being land labourers on 17.2.1997 which was duly approved by the SubDivisional Officer vide order dated 26.6.1997.

It is stated that subsequently proceedings were initiated for cancellation of the lease deed, however, the lease, granted in favour of the petitioners, was confirmed vide order dated 03.02.2007 and the revision filed against the said order, was also decided in faovur of the petitioners.

The grievance of the petitioners is that despite the same the name of petitioners has not been mutated in the revenue record. He further argues that section 33 of Land Revenue Act casts a duty on the Collector to maintain the record and to make the necessary corrections therein on the annual basis, however, no action is being taken.

Considering the submission made and the mandate of section 33 of Land Revenue Act, the

writ petition is disposed off with liberty to the petitioners to approach the Sub-Divisional Officer, Sikandarabad, District Bulandshahar (respondent no. 2) by filing an appropriate application within a period of three weeks from today. In the event such application is filed along with copy of this order the Tehsildar, Tehsil Sikandarabad, District Bulandshahar (respondent no. 3) shall take steps in accordance with law, as expeditiously as possible, preferably within a period of four months from the date of filing of the application and copy of this order.

The petition is disposed of in terms of the said direction.

Copy of the order downloaded from the website of Allahabad High Court shall be accepted/treated as certified copy of the order.
