This matter is placed before this Bench by the order of Hon'ble the Chief Justice.

Heard learned counsel for the parties and perused the petition.

By way of this petition, the petitioner is seeking following relief:

(i) Issue a writ, order or direction in the nature of writ of mandamus directing the respondent No.4 to decide the objection dated 11.02.2015 as well as 25.02.2021 moved by the petitioners under sub-section (5) of Section 3(G) of the National Highways Act, 1956 following the ingredients as provided under sub-section (7) of Section 3 (G) of the National Highways Act, 1956 expeditiously within one month or within stipulated period as fixed by this Hon'ble Court.

(ii) Issue a writ, order or direction in the nature of writ of mandamus directing the respondent No.4 to provide proper compensation to the petitioners for their valuable landed property after following the ingredients of sub-section (5) of Section 3(G) of the National Highways Act, 1956 pursuant to the report dated 22.06.2017 forwarded by the respondent No.2 on 30.08.2017 before the Project Director of National Highways Authority of India.

In such view of the matter, without expressing any opinion on the merits of the case, we dispose of this petition finally, with a direction to the respondent No.4, Competent Authority/Sub Divisional Officer (Sadar), Chandauli to decide the objection dated 11.02.2015 and 25.02.2021 of the petitioners pending before him on or before 31.03.2022.

This petition shall also be sent along with order of this Court in physical mode to the respondents authority.
