This matter has been placed before this Court by the order of Hon'ble the Chief Justice.
Heard learned counsel for the petitioner and learned counsel for the respondents.
The present writ petition has been filed for the following reliefs:
"(i) issue a writ, order or direction in the nature of mandamus directing and commanding the respondent authorities to remove the complete encroachment and construction made by private respondents over Khasra/Arazi No.104 area measuring 0.021 hectare situated at Village Tejsinghpur, Tehsil Bhadohi, District Bhadohi, expeditiously within stipulated period.
(ii) issue a writ, order or direction in the nature of mandamus directing the respondents authorities to effectively proceed with representation as well as complaint on-line dated 23.03.2021 and 13.07.2021 moved by petitioner within the time as specified by this Hon'ble Court. "
The prayer prayed for requires to be granted at this stage.
If the representation is found genuine, the respondent No.2, District Magistrate, Bhadohi shall decide the representation of the petitioner on or before 31st December, 2021. This petition
shall also be considered as further representation pursuant to the representation made by the petitioner on 23.06.2021.
With the aforesaid direction, this petition is disposed of .
It is made clear that we have not gone into the merits of the matter at this stage.
