On the last occasion, time was granted to learned counsel for petitioner to file supplementary affidavit complying the earlier order dated 31.05.2016.
It has been brought to the notice of the Court that petitioner has already filed a civil suit against the Bank and the said fact has not been disclosed in the writ petition.
In 2016, petitioner was required to file an affidavit bringing on record the said fact but till date, he has not filed the same.
From perusal of prayer made in writ petition, it transpires that writ petitioner challenges the recovery citation dated 01.01.2014. It appears that by efflux of time, the writ petition has become infructuous.
In view of above, writ petition is dismissed as infructuous.
