- This is the second bail application being filed by applicant, Mustakim in Case Crime No. 101 of 2020, under Sections- 368 IPC and 16/17 Protection of Children from Sexual Offences Act, 2012 and 3(2)(v) of Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989, Police Station Gajraula, District Amroha.
- From perusal of record it transpires that the first bail application was rejected on 26.11.2020 considering the statement of the victim recorded under Section 164 Cr.P.C.
- From perusal of material on record it is apparent that no new fact has been brought on record nor there is any change of circumstances.
- The question with regard to fresh argument to be considered in second bail application on those very facts that were available to the accused while his earlier bail application was moved and rejected, came for consideration before Division Bench of this Court in case of Satya Pal vs. State of U.P., 1998 (37) ACC 287 . Division Bench relying upon the decision of Apex Court in case of State of Maharastra vs. Buddhikota Subha Rao, AIR 1989 SC 2292 held as under:-
