Heard Shri Umesh Kumar Singh, learned counsel for the petitioner, Shri J.N. Maurya, learned Chief Standing Counsel as well as Shri Abhinav Ojha, learned counsel for the respondent nos.4 & 5.

The petitioner is assailing the validity of the order impugned dated 28.5.2020 passed by respondent no.2 i.e. District Magistrate, Fatehpur, whereby representation in the light of the order dated 28.11.2019 passed in Writ Petition No.38964 of 2019, Aisha Bibi Vs. State of U.P. and others, has been disposed of.

An objection has also been raised by Shri J.N. Maurya, learned Chief Standing Counsel that the petitioner herself moved an application on 18.10.2020 to the District Magistrate indicating therein that some persons are trying to encroach upon the land and demarcation of the property has been asked for.

In such circumstances it would be appropriate for the petitioner to move appropriate application under Section 24 of the U.P. Revenue Code, 2006 for demarcation of the property.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of with observation that in case the petitioner moves appropriate application as per the provisions contained under Section 24 of the U.P. Revenue Code 2006 within two weeks from today, the same would be considered and proceeding in question be finalised in accordance with law in further three months time, but certainly after according opportunity of hearing to all the stake holders in the matter.

The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity

proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.

The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
