Heard Shri Siddharth Singhal, learned counsel for the petitioner and learned Standing Counsel. Shri Kaushalendra Nath Singh appears for New Okhla Industrial Development Authority (in short "NOIDA").
The petitioner is before this Court for a direction to respondent nos.2 and 3 to grant the benefits of zero period in terms of the Zero Period Policy dated 28.03.2016 from 03.05.2013 upto the date when the actual physical possession would be handed over to the petitioner; for a direction to respondent nos.2 and 3 to handover the physical possession of the plot being Plot No.B05, SC-01, Sector 150 Noida situated at Village Kondali Bangar, Distt. Gautam Budh Nagar and for a direction to restrain the respondents from taking any coercive measures towards recovery of premium without making adjustment in terms of zero period policy of the premium already deposited.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of with observation that in case the petitioner makes fresh representation to second respondent i.e. Chief Executive Officer, NOIDA ventilating its grievances within one week, the same would be considered and proceeding in question be finalised in accordance with law in further six weeks.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
