The auction of the pond situate over plot no. 263 was done on 14.11.2019. Thereafter, the petitioner had deposited the required amount i.e. Rs. 2,500/- as part payment. When the official approval was not being granted, the petitioner was forced to file the instant writ petition.
When instructions were called for, the Sub Divisional Officer filed a personal affidavit and in paragraph 7 of the affidavit it was stated that the pond was not vacant.
In paragraph 9 of the affidavit, it was stated that a decision had been taken by the Sub Divisional Officer on 25.11.2020 disapproving the petitioner's bid. The disapproval to the proceedings which was initiated vis a vis the auction dated 14.11.2019 were, thereafter, communicated to the petitioner.
The auction had taken place on 14.11.2019. Thereafter only when the writ petition was filed the Sub Divisional Officer told the reason as to why the auction was not bieng confirmed. The petitioner definitely had to run from pillar to post to get the approval. Only when the petitioner filed the writ petition the disapproval was handed over to him. Also the reason why the auction had been disapproved was told after the filing of the writ petition. This is not the way Government Officials should work.
Under such circumstances, apart from the money which the petitioner had deposited, the petitioner would be given a sum of Rs. 10,000/- as compensation.
With these observations, the writ petition is disposed of.
