Heard learned counsel for the parties and perused the record.

The prayer in the writ petition is to issue a direction to the respondent to provide promotion to the petitioner to the rank of Head Constable from the due date in accordance with the Government Order. The grievance raised in the writ petition is that the petitioner was found fit by the Promotion Committee but the recommendation dated 30.12.2020 had not been given effect though juniors to the petitioners have been promoted.

On a pointed query made by the Court as to whether the departmental proceeding against the petitioner is pending, the attention of the Court is invited to paragraph '15' of the writ petition which reads as under:-

" 15. That it appears that petitioner's selection has been kept in sealed cover by the repondents due to pendency of an alleged enquiry in District Hapur".

It is, thus, clear that the recommendation of the Committee had been kept in a sealed cover by the respondent due to pendency of the enquiry against the petitioner.

No direction, as such, can be issued.

¶11

However, it is kept open for the respondent to take into consideration the request of the petitioner for grant of promotion after conclusion of the departmental proceeding, if any.
