Heard Sri K.B. Dixit, learned counsel for the petitioner and Sri Pranav Ojha, learned Additional Chief Standing Counsel for the State.

Petitioner is claiming arrears of suspension allowance from period 23.06.2007 to 31.08.2013. It is submitted that in the counter affidavit in Para-21, Director of Education (Secretary) has mentioned that case of the petitioner has been forwarded to the Special Secretary, Secondary Education, Anubhag-5, Government of U.P., Lucknow, as his financial capacity is only to disburse up to only a sum of Rs. 5,00,000/- (five lakhs rupees) whereas dues claimed by the petitioner are to the tune of Rs. 10,39,679/- (ten lakhs thirty nine thousand six hundred seventy nine rupees). It is submitted that said Special Secretary has not passed any orders, though, matter is pending for his consideration for over two years.

Sri Pranav Ojha submits that in the personal affidavit of Director of Education (Secretary) in Para-8, it is mentioned that petitioner was apprehended and sent to jail in connection of murder case under Section 302 IPC.

In view of such facts, let Additional Secretary of Secondary Education decide petitioner's pending claims, strictly in accordance with rules and regulations in this behalf through a speaking order within 60 days of communication of this order.

Accordingly, petition is disposed off.

This Court has not expressed any opinion on the merits of the case.
