Heard learned counsel for the petitioner, Sri Abhijeet Srivastava, learned counsel for the respondent no.2 and Sri Rajesh Kumar Srivastava, learned counsel for the respondent no.3 and learned Standing Counsel for the respondent State.

Solitary grievance is of non payment of time scale as well as gratuity, pension, leave encashment and other retirement benefits. Petitioner further claims interest.

The petitioner retired on 30.06.2021. He had represented for his claim in the year 2018.

In such circumstances, no useful purpose would be served in keeping the matter pending or calling for a counter affidavit, at this stage.

Accordingly, the writ petition is disposed of with the direction that in case the petitioner files a fresh representation before respondent no.2, within a period of two weeks from today alongwith a copy of this order and annexing thereto all relevant documents on which he relies, the said respondent shall proceed to consider the claim of the petitioner strictly in accordance with law by passing a reasoned and speaking order, as expeditiously as possible, preferably within a period of three months from the date of such representation being filed by the petitioner. Further, any amount that is found payable to the petitioner, the same may be paid out to the petitioner within further period of two months together with statutory interest, if any.
