Petitioner claims entitlement to be considered for promotion on the post of Head Master at Primary School, Musaldhara, Ghorawal, Sonbhadra. He claims to be working at that institution as Assistant Teacher since 30.6.2011.

On earlier order, written instructions have been obtained by Shri S K Verma, learned counsel for respondent nos. 2 to 4. The same have been made available to learned counsel for the petitioner.

Inasmuch as, it appears that the petitioner is entitled to be considered for promotion, without entering into merits as to whether the petitioner is to be promoted or not, present petition is disposed of with a direction that in case the petitioner files a fresh representation raising his claim along with a copy of this order before the respondent no.4 - District Basic Education Officer, Sonbhadra, within a period of two weeks from today, the said respondent shall pass appropriate orders on the petitioner's claim thus made. In case, the said respondent proceeds to reject the claim made by the petitioner to be considered for promotion, it is expected that adequate reasons be communicated to the petitioner within a period of one month from the date of communication of this order. In case, the petitioner is found entitled to be considered for promotion, the said respondent shall take further action in that regard, as expeditiously as possible.
