Heard learned counsel for the petitioner, learned Standing Counsel for respondent no.1 and Sri Yashwant Singh, learned counsel for respondent nos.2 & 3.

The petitioner in the present writ petition has sought a direction upon respondent-authority to release leave encashment, group insurance and gratuity with 18% interest.

The petitioner has retired from the post of Sweeper on 18.08.2013. The aforesaid dues i.e. leave encashment, group insurance and gratuity have not been paid to the petitioner till date. The petitioner in this respect has submitted several representations to respondent-authority.

The grievance of the petitioner is that respondent no.3 is sitting tight over the matter and has not yet released the aforesaid retiral dues in favour of petitioner.

Learned counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.3 to consider the grievance of the petitioner.

Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before the respondent no.3-Nagar Ayukt, Muncipal Corporation, Kanpur Nagar alongwith the copy of this order downloaded from the official website of High Court, Allahabad raising all his grievances within a period of two weeks from today. In case any such representation is filed by the petitioner, the respondent no.3 shall consider and decide the same by reasoned and speaking order within a period of two months thereafter.

The writ petition is disposed off subject to the observations made above.
