The applicant has preferred present contempt application with the prayer to summon the opposite parties and punish him for wilful and deliberate disobedience of the order dated 29.01.2018 passed in Second Appeal No.369 of 2017 (Smt. Veervati @ Smt. Vimla and another Vs. Mohd. Alam).
After some arguments a prayer has been made to dismiss the present contempt petition with liberty to file appropriate application in the pending second appeal as provided under Section 39 Rule 2(A) CPC.
Prayer is allowed.
The present contempt petition is dismissed with liberty as prayed.
