The present application under Section 482 Cr.P.C. has been filed seeking to quash the non-bailable warrant dated 01.12.2020 issued by the Chief Judicial Magistrate, Mahoba in Case No.3164 of 2007 (State of U.P. vs. Jitendra Kumar and Others), arising out of Case Crime No.1133 of 2007, under section 467, 468, 471, 409, 218, 420 IPC, Police Station Kotwali Mahoba, District Mahoba pending before the Chief Judicial Magistrate, Mahoba.
Counsel for the applicant, at the very outset, fairly submits that the necessary ingredients for invocation of the provisions under section 482 Cr.P.C. are not made out in the facts of the case. He accordingly submits that he does not wish to press the reliefs, as prayed for, in the application. The reliefs sought in the present application are therefore not entertained.
Learned counsel states that the applicants would submit to the jurisdiction of the court below and seek bail.
Needless to say that in case any such application for bail is moved, the court below would be expected to pass appropriate orders thereon in accordance with the settled principles of law.
The application stands disposed of accordingly.
