The present application under Section 482 Cr.P.C. has been filed seeking to quash the entire proceedings of Case No. 8519 of 2020, arising out of Case Crime No. 129 of 2018, under Sections 302, 34 IPC, Police Station Sikandra, District Agra pending before the court of the Chief Judicial Magistrate, Agra and also the charge sheet dated 19.02.2020 and cognizance order dated 01.10.2020.
Learned counsel for the applicant after making submissions to some extent fairly submits that necessary ingredients for invocation of provisions of 482 Cr.P.C. are not made out in the facts of the present case. He also states that the applicant has already been enlarged on bail in terms of an order dated 05.08.2020 passed in Criminal Misc. Bail Application No.13812 of 2020. Accordingly, he does not wish to press the present application.
The application stands accordingly dismissed.
