Heard Shri Prem Sagar Verma, learned counsel for the petitioners, Shri Vinod Kant, learned Additional Advocate General appearing along with Shri Jhamman Ram, learned AGA for the State opposite party and Ms. Durga Tiwari, learned counsel who states that she has recieved instructions on behalf of respondent no.7 and has filed her vakalatnama today in court.

Pursuant to rule nisi issued earlier the petitioner no. 2 (corpus) has been produced in Court by Sub-Inspector Shri Manoj Kumar (PNO-172410528) and Constable Shri Brijendra Singh, Police Station-Panki, District Kanpur Nagar, who have identified the corpus.

The petitioner no. 1 is also present in Court and has been identified by Shri Prem Sagar Verma, her counsel.

Learned AGA on the basis of an inquiry made from the petitioner no. 2-corpus in Court, submits that he has stated that he is a major and possesses a BTech Degree in Electrical Engineering. The petitioner no.2-corpus has stated that the petitioner no. 1 is known to him for almost five years. He has claimed that they were married and were living together as husband and wife at Prayagraj where he was having a job. He has further stated that due to some pressure he was forced to leave his job and go to the place of respondent no.7, his father, at Kushinagar. The petitioner no. 2 has expressed his willingness to take the responsibility of the petitioner no. 1, who he asserts to be his wife.

Having regard to the aforesaid, the rule nisi issued earlier is made absolute. The petitioner no. 2 would be at liberty to go along with the petitioner no. 1, wherever they may desire.

The habeas corpus petition stands allowed accordingly.
