Hon'ble Ajay Bhanot,J.
Sri Krishna Kumar Singh, learned counsel for the petitioner submits that the orders passed by the Human Rights Commission and the impugned recovery violation of principles of natural justice were passed. Further, the order dated 21.03.2020 communicated by the State Human Rights Commission overlooks the fact that the delay had in fact been explained, inasmuch as, the complainant arrived at the police station only on 20.07.2018.
Matter needs consideration.
Learned Standing Counsel for the State - respondents prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Till the next date of listing, the effect and operation of the impugned order dated 31.07.2020 passed by the Additional Secretary, Home, Government of U.P., Lucknow shall remain stayed.
