Heard learned counsel for the applicant and Dr. Neeraj Rai, learned counsel for the opposite party.
The applicant is before this Court against the wilful defiance of the order dated 30.09.2019 passed in Writ Petition No.14975 of 2019 (Manish Kumar Tripathi v. State of U.P. & Anr.), which for ready reference is quoted as under:-
"Heard Sri Akshayavar Nath Pandey, learned counsel for the petitioner and learned Standing Counsel for the State-Respondents.
The petitioner claims that he had applied for selection of Principal pursuant to an advertisement No. 3 of 2013. It is submitted that more than five years have passed but even selection proceedure has not been initiated nor advertisement has been cancelled.
The writ petition is disposed of with the observation that the petitioner may approach the Board by filing a representation. In case such a representation is filed, the Board shall pass an appropriate order in accordance with law, as far as possible, within a period of two months, from the date of production of certified copy of this order before it."
On the matter being taken up today, learned counsel for the opposite party submits that the U.P. Secondary Education Service Selection Board (in short "the Board") was not functional from 2013 to 2017. He has also apprised on the basis of instructions that process is on for selection in response to Advertisement No.3 of 2013 and every endeavour shall be made by the Board to finalise the selection proceeding in question by May, 2012.
In view of above, the Court is not inclined to proceed further in the matter under the Contempt of Courts Act. The contempt application stands disposed of accordingly. Notices, if any, stand discharged.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the applicant alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the
official website of High Court Allahabad and shall make a declaration of such verification in writing.
