Heard learned counsel for the applicants and learned A.G.A. for the State and perused the record.

It is urged that the applicant no. 1 is the mother-n-law and the applicant no. 2 is daughter-in-law of the deceased; the marriage of the son of the applicant no. 1 and the deceased was solemnized in 2019; the couple was living at Gujarat; specific allegation is against co-accused Pawan Giri (husband of the deceased); general allegations have been leveled against the applicants; applicant no. 2 is a student and she has her exams; applicants are innocent and has been falsely implicated in the instant case; applicants having no criminal antecedents are languishing in jail since 27.11.2019, hence the applicants may be released on bail.

Learned A.G.A. has vehemently opposed the prayer for bail contending that the marriage had taken place in April 2019 and the deceased succumbed to her injuries on 24 November 2019; there are specific allegations of harassment for dowry against the applicants; the deceased had shortly returned from her matrimonial home on 8 November 2019 and within two weeks she died; the investigation is going on, therefore, it will not be in public interest to enlarge the applicants on bail.

Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicants Laxmi Devi and Km. Kriti Giri in Case Crime No. 169 of 2019, under Sections 498A, 304-B I.P.C. and Section 3/4 of D.P. Act, P.S. Garwar, District Ballia.

Accordingly, the bail application is rejected.

However, the trial court is further directed to expedite the trial of the aforesaid case and conclude the same expeditiously from the date of production of a certified copy of this order.

The Registrar General of this Court is directed to send a copy of this order to the learned trial court for compliance.
