Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.
Learned counsel for the applicant submits that the allegation against the applicant is that the deceased, a 16 year boy, was taken by co-accused Mausam at the place of applicant, who is a Contractor, the deceased demanded his wages which was not paid, consequently, the deceased committed suicide by consuming poison; the applicant has been falsely implicated in the instant case; there is no specific role assigned to the applicant of the offence; applicant having no criminal antecedents is languishing in jail since 14.11.2019, hence the applicant may be released on bail.
Learned A.G.A. has vehemently opposed the prayer for bail contending that the statements recorded under Section 161 Cr.P.C. supports the prosecution version that the applicant, who is a contractor had abetted in commission of the offence.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Dimpal Theekedar @ Gurjeet Singh involved in Case Crime No. 140 of 2019, under Sections 306, 323 I.P.C., P.S. Hastinapur, District Meerut.
Accordingly, the bail application is rejected.
However, the trial court is further directed to expedite the trial of the aforesaid case and conclude the same expeditiously from the date of production of a certified copy of this order.
The Registrar General of this Court is directed to send a copy of this order to the learned trial court for compliance.
