Heard learned counsel for the applicant, learned A.G.A. and learned counsel for the informant. Perused the record.
It is urged by learned counsel for the applicant that the F.I.R. narrative is concocted lodged after two days of the incident and the inquest report; the applicant is innocent; he was duly engaged with the victim; there was no intention to kill the victim; the victim committed suicide out of frustration; the applicant is in jail since 15 September 2019.
In rebuttal, learned A.G.A. and learned counsel for the informant, submits that the engagement was merely an eye wash and a fraudulent step to avoid the criminal prosecution; the applicant after being engaged insisted the victim to have relationship with the other co-accused; she was subjected to mental harassment, consequently, committed suicide. There was no intention to marry, but the engagement was merely a camouflage for physically and mentally torturing the victim; the victim is approximately aged about 17 years.
It is not in the public interest to enlarge the applicant on bail
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant.
Accordingly, the bail application is rejected.
The trial court is directed to expedite the trial of the aforesaid case and conclude the same expeditiously on day to day basis from the date of production of a certified copy of this order, if, there is no legal impediment.
The Registrar General of this Court is directed to send a copy of this order to the learned trial court for compliance.
