Heard learned counsel for the parties and perused the record.

This bail application has been filed on behalf of the applicant involved in Case Crime No. 224 of 2019, under Section 498A, 304B, 120B IPC and 3/4 D.P. Act, P.S. Harraiya, District Basti.

It is urged by learned counsel for the applicant that applicant is the mother-in-law of the deceased; it is alleged that the deceased was subjected to harassment and tortured for dowry; cause of death is asphyxia due to antemortem hanging; there is general allegation against the applicant and no specific role has been assigned to the applicant; applicant is languishing in jail since 28.10.2019, and in case applicant is released on bail, she will not misuse the liberty of bail.

Learned Additional Government Advocate, in rebuttal, submits that the postmortem examination report shows that there is injury other than on the neck; statement under Section 161 Cr.P.C. of the brother and mother of the deceased supports the prosecution version; deceased succumbed to injury for want of dowry, torture and harassment.

Considering the facts and circumstances of the case, I am not inclined to allow the bail application at this stage.

The bail application is, accordingly, rejected.
