Heard learned counsel for the applicant and learned A.G.A. for the State respondent.

The present bail application has been filed with the prayer to enlarge the applicant on bail in case crime no. 618 of 2010 under Section 396, 412 IPC, P.S. Hayat Nagar District Moradabad during pendency of trial.

It is contended by the learned counsel for the applicant that earlier the applicant was granted bail by the court below and was regularly attending the court. Thereafter, the applicant had gone to another district for his livelihood and his local counsel did not inform him, therefore, he could not appear on the date fixed. It is also contended that there are no chances of the applicant of fleeing away from the judicial process or tampering with the prosecution evidence and now he undertakes to appear on each and every date before the court concerned. It is further contended that the applicant is in jail since 05.08.2019 and if he is released on bail, he will not misuse the liberty of bail. Learned A.G.A. has opposed the prayer for bail.

Without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, let the applicant Ram Bahadur involved in case crime no. 618 of 2010 under Section 396, 412 IPC police station Hayat district Moradabad be released on bail on his furnishing a personal bond and two local sureties each in the like amount to the satisfaction of court concerned subject to the conditions that he:

shall appear on the date fixed by the trial court;

¶10

shall not tamper with the prosecution evidence;

¶11

shall not pressurize the prosecution witnesses; and

¶12

shall not leave the district without prior permission of the court.

In case of default of any of the aforesaid conditions, this bail order shall automatically stand cancelled. Order Date :- 10.9.2020
