Heard learned counsel for the applicant and learned A.G.A. for the State respondent.

Submission of learned counsel for the applicant is that the applicant has been falsely implicated due to ulterior motive. It is further submitted that nothing has been recovered from the possession of the applicant. It is also submitted that two coaccused have been granted bail by this Court in Criminal Misc. Bail Application No. 16678 of 2020, Maqtoom v. State of U.P., and Criminal Misc. Bail Application No. 20024 of 2020, Irfan v. State of U.P., vide orders dated 31.08.2020 and 06.08.2020 respectively. It is next contended that applicant has no criminal history and there are no chances of the applicant of fleeing away from the judicial process or tampering with the prosecution evidence. It is further contended that the applicant is in jail since 25.06.2020 and if he is released on bail, he will not misuse the liberty of bail.

Learned A.G.A. has opposed the prayer for bail.

Perused the first information report as well as averments made in the application..

Without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, let the applicant- Ayub, involved in Case Crime No. 228 of 2020, under Section 3/5/8 of the Cow Slaughter Act, Police Station Bhognipur, District Kanpur Dehat, be released on bail on his furnishing a personal bond and two local sureties each in the like amount to the satisfaction of court concerned subject to the conditions that he:

shall appear on the date fixed by the trial court;

shall not tamper with the prosecution evidence;

¶11

shall not pressurize the prosecution witnesses.

In case of default of any of the aforesaid conditions, this bail order shall automatically stand cancelled.
