Submission of learned counsel for the applicant is that a well qualified lady Mrs 'X' who at the time of marriage completed her Master course of Science in Microbiology and gainfully employed in Tanya Meat Factory, Meerut, has lodged an F.I.R. against her husband, mother-in-law, father-in-law, brother-inlaw and other family members, levelling an ever abhorring and disgraceful allegations against father-in-law. The language used in the F.I.R. reflects the mental condition of the informant who in order to book the alleged named accused persons can stoop down to this low level. As mentioned that informant is the victim who has completed her M.Sc (Microbiology), the Court is not in a position to reiterate the allegations or the prosecution story mentioned in the F.I.R. From the F.I.R. is is clear that the marriage of the victim was solemnized with the husband Zaki Khan on 02.4.2018 and as per the allegations of the F.I.R., on 17.02.2019 the informant was ousted from the matrimonial house on account of dowry demand. After delay of five months, the present F.I.R. came into existence with levelling every sort of canard. From the text of the F.I.R. it is clear that its sole and gist is a dowry related misbehaviour or harassment. In order to make the entire scenario more aghastly, the allegation of attempt to commit rape was added with the help and aid of her father, who is a police personnel. Besides this, she has declined herself to be medically examined. The applicant is in jail since 20.6.2020 having no criminal antecedents.
