Heard learned counsel for the applicant, learned Additional Government Advocate for the State/opposite party no.1 and perused the record with the assistance of learned counsel for the parties.
This application under Section 482 Cr.P.C. has been filed by the applicant for quashing of the orders dated 23.04.2012 and 21.08.2012 as well as entire proceedings of Case No. 1425/9 of 2012 arising out of Case Crime No. 98 of 2011, under sections 420, 467, 468, 471 IPC pending in the court of ACJM, court No.1, Muzaffar Nagar.
At the very outset Mr. Nipun Singh, learned counsel for the applicant submitted at the bar that with the lapse of time no cause of action survives and also the present application has become infructuous, therefore, he does not want to press this application and he may be permitted to withdraw this application. It is also pointed out that withdrawal application has been filed in the instant case, which is on record.
In view of statement made at the bar by Mr. Nipun Singh, learned counsel for the applicant, the withdrawal application is allowed and the present application under section 482 Cr.P.C. is rejected as withdrawn.
