Heard learned counsel for the applicants, learned Additional Government Advocate for the State/opposite party No.1 and perused the record with the assistance of learned counsel for the parties.
This application under Section 483 Cr.P.C. has been filed by the applicants for quashing of the proceedings of Complaint Case No. 4343 of 2016 (Smt. Usha vs Darpan Kumar), under sections 498-A IPC and section 3/4 of Dowry Prohibition Act, police station Siyana, district Bulandshahr.
At the very outset learned counsel for the applicants submitted that on account of some defects, he does not want to press this application at this stage and he may be permitted to withdraw this application with liberty to file afresh with better particulars.
In view of statement made by Mr. Ashwini Kumar Singh, learned counsel for the applicants at the bar, this application under section 483 Cr.P.C. is rejected as withdrawn with liberty to file afresh at the appropriate stage with better particulars.
Office is directed to return the certified copy, if any, to the learned counsel for the applicants after retaining photostat copy of the same on record as per rules.
