Heard Sri Chandra Kumar Rai, learned counsel for the petitioner and Sri Sunil Kumar Maurya, learned Standing Counsel appearing for State-respondents.
By means of the present petition, the petitioner has sought a direction to Respondent No.2, Assistant Tehsildar (Azamatgarh) Sagari, Azamgarh to decide the Restoration/Recall Application dated 24.05.2018 filed by the petitioner against the order dated 19.04.2018 passed in Case No. 218/241/698/678/T201815060702394 (Bheem Sen and others vs. Ram Raj), under Section 34 of the U.P. Revenue Code, 2006 within a stipulated period.
Learned counsel for the petitioner submits that the petitioner would appear before the court below in the pending matter and would not seek any unnecessary adjournment, and a direction may be issued for the pending matter to be decided within a reasonable time period.
Learned Standing Counsel appearing for State-respondents has no objection to the prayer so made.
With the consent of the parties the petition is disposed of with an observation that in case the petitioner appears before the court below and does not seek any unnecessary adjournment, it is expected that the court below would make an endeavour to decide the aforesaid case expeditiously in accordance with law, preferably within three months from the date of presentation of a certified copy of this order, if there is no other legal impediment.
