Heard Sri Anuj Bajpayee, Advocate holding brief of Sri Om Prakash Singh, learned counsel for the petitioner, Sri Sunil Kumar Maurya, learned Standing Counsel appearing for respondent no.1.
By means of this writ petition, the petitioner has come to this Court with a prayer that the court below may be directed to decide Appeal No.31 of 2015 (Vinod Vs. Yaswant & Ors.), under Section 331 of UPZA & LR Act, 1950 pending before respondent no.1/Commissioner, Azamgarh Division, Azamgarh.
Learned counsel for the petitioner submits that the petitioner would appear before the court below in the pending matter and would not seek any unnecessary adjournment, and a direction may be issued for the pending matter to be decided within a reasonable time period.
Learned Standing Counsel appearing for respondent no.1 has no objection to the prayer so made.
With the consent of the parties the writ petition is disposed of with an observation that in case the petitioner appears before the court below and does not seek any unnecessary adjournment it is expected that the court below would make an endeavour to conclude the pending proceedings in accordance with law expeditiously, preferably within one year from the date of presentation of a certified copy of this order, if there is no other legal impediment.
