Heard Sri Harish Kumar Tripathi, learned counsel for the petitioner, Sri S.N.Pandey, learned Standing Counsel for the respondent nos. 1 to 3 and Sri Tariq Maqbool Khan, learned counsel for the respondent no. 4.
The only prayer made by learned counsel for the petitioner is for a direction to the respondent no. 2 to decide the stay application filed in an appeal bearing no. D201805440002561 (Nagina Vs. Gram Sabha) under Section 67 (5) of U.P. Revenue Code, 2006.
The counsel for the petitioner submits that although the appeal was registered on 26.9.2018 and notices were issued to the parties, the stay application remains pending and the petitioner is facing imminent threat of being dispossessed and as such, the stay application may be decided at an early date.
Learned Standing Counsel as well as counsel for the Gaon Sabha have no objection to the prayer so made.
With the consent of the parties the writ petition is disposed of with an observation that in case the petitioner appears before the court concerned and does not seek any unnecessary adjournment it is expected that the court below would make an endeavour to decide the stay application expeditiously, preferably within six weeks from the date of presentation of a certified copy of this order, if there is no other legal impediment.
