Under an order dated 5th June, 2018, the Sub Divisional Magistrate, Shahganj, District Jaunpur withdrew the license dated 18th May, 2018 granted in favour of the petitioner to use amplifier at a mosque. While cancelling the license, it is stated that the use of amplifier or public addressing system may cause injury to the peace and tranquility of the area.

The order impugned as per learned counsel appearing on behalf of the petitioner does not disclose any reason for having apprehension for injury to public interest or to the peace and tranquility of the area.

A counter affidavit has also been filed. On behalf of the respondents stating therein that in the village concerned there is only 2% population of minority and 98% of majority and that may cause annoyance and a tense situation too may exist there. Therefore, the Sub Divisional Magistrate passed the order impugned.

From perusal of the order dated 5th June, 2018 as well as the averments contained in the counter affidavit, we do not find any reason to arrive at the conclusion that any effort is made for causing injury to the peace and tranquility of the area.

Be that as it may, in view of the fact that the license granted also expired on 17th July, 2018, therefore, we do not find any just reason now to set aside the order aforesaid. Accordingly, the writ petition is disposed of by keeping the petitioner at

liberty to move an application afresh for renewal of the license in accordance with law. Order Date :- 20.2.2019 VMA
