The present petition seeks to challenge the order dated 10.7.2019 passed by the respondent no. 3, Presiding Officer, Labour Court Noida Gautam Budh Nagar in Adjudication Case No. 77/2014 whereby the application dated 24.12.2018 filed by the respondent no. 4-employer has been allowed and the exparte orders dated 23.2.2017, 22.3.2017 and 9.5.2017 have been recalled fixing 22.8.2019 for filing of the written statement by the respondent-employer.
Counsel for the petitioner has submitted that he is not pressing the writ petition in so far as the reliefs prayed for are concerned and his only prayer is that the proceedings before the Labour Court which are said to be pending since the year 2014, may be expedited.
Sri Jamal Ahmad Khan, learned counsel for the respondent no. 4 has no objection to the prayer so made.
Counsel for the parties have jointly submitted that they would appear before the court below and would not seek any unnecessary adjournment.
Having regard to the aforementioned facts and circumstances, the present petition is disposed of with an observation that in case the parties appear before the Presiding Officer, Labour Court Noida, Gautam Budh Nagar/respondent no. 3 and do not seek any unnecessary adjournment it is expected that the court below would make an endeavour to decide the aforesaid case expeditiously in accordance with law provided there is no other legal impediment.
