Supplementary affidavit filed today is taken on record.
The present writ petition seeks to challenge the order dated 31.08.2018 passed by the Controlling Authority, under the Payment of Gratuity Act/Assistant Labour Commissioner U.P., Prayagraj.
Sri Saurabh Srivastava, learned Chief Standing Counsel appearing for the petitioners at the very outset submits that certain relevant facts necessary for adjudication of the controversy involved could not be placed before the Controlling Authority under the Payment of Gratuity Act/Assistant Labour Commissioner U.P., Prayagraj, when the matter was pending before the said Authority.
Accordingly, a prayer is made to withdraw the present writ petition with liberty to approach the Controlling Authority and place the relevant facts before the authority concerned by moving an appropriate application.
Sri Gaurav Srivastava, learned counsel appearing on behalf of respondent no.3 has no objection to the prayer so made.
As prayed, the writ petition is dismissed as withdrawn with the liberty aforesaid.
