no.2 it is contended that a letter dated 8.9.1970 was written by the Indian Council of Agricultural Research to the Principal, R.B.S. Agriculture College, Bichapuri- Agra (U.P.), which clearly indicates that the scheme is designed for research on identified subject/mandate. The scheme will continue till the objectives are fulfilled. It is further contended that the schedule of terms and conditions governing the grant-in-aid from the council. In the letter dated 8.9.1970 it is clearly stated that the staff of the project/scheme should be chosen by selection on the normal recruitment rules and procedures applicable to the grantee institutions may be followed. It is further stated that in view of the same, all the three petitioners are staff members of R.B.S. Agriculture College, Bichapuri- Agra (U.P.) and governed by Service Rules and Regulations of the concerned college. The Council vide letter dated 12.11.2007 reiterates the above mentioned facts pertaining to the letter dated 8.9.1970. It is again stated by the Council that the appointing authority in this case is Management Committee of R.B.S. Agriculture College, Bichapuri- Agra (U.P.) and Rules and Regulations of the college are applicable. Therefore, the case may be dealt in accordance with the College Rules. The staff of the projects are selected by the college and governed by the Rules and Regulations of the College. The I.C.A.R. does not have employer or employee relationship with the staff of the college. In view of the same it is contended that the respondent no.2 have nothing to do with the issue raised in the present writ petition.
