List has been revised. Nobody is present on behalf of either of the parties.
From perusal of the record, it transpires that an interim order was granted in favour of the petitioner on 11.2.2014. By the said order, directions were given to the Commissioner, Agra Division, Agra that he may go on in respect of pending proceedings but the final judgement shall not be delivered. It further reveals from the perusal of the record that as many as two counter affidavits along with stay application have been filed. One application has been filed by the learned Standing Counsel on 4th July, 2017 and another has been filed by counsel for the respondent No.6/Gaon Sabha on 3rd September, 2017. It further reveals that no rejoinder affidavit has been filed in response to the same.
In these circumstances of the case, since nobody is present on behalf of the petitioner, the writ petition is dismissed in default.
Interim order dated 11.2.2014 is hereby vacated.
