Heard learned counsel for the parties.

The petitioners are retired Class-IV employee of Adarsh Junior High School, Saudhan (Mawana), District Meerut and K.V. Junior High School, Pachgaon, District Meerut. All the respondents have superannuated and their gratuity has not been paid. Petitioners in this regard have submitted representations to respondent no.2- District Basic Education Officer, Meerut, copy of which is annexed as Annexure 4 to the writ petition.

Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.2 to consider the grievance of the petitioners.

Considering the facts and circumstances of the case, without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioners to file a fresh representation before the respondent no.2-District Basic Education Officer, Meerut raising all their grievances within a period of two weeks from today. In case any such representation is filed by the petitioners, the respondent no.2 shall consider and decide the same by reasoned and speaking order within a period of three months thereafter.

With the aforesaid observations, the writ petition is disposed of .
