Heard Sri Janmed Kumar, learned counsel for the petitioner and Sri Sanjay Kumar Srivastava, learned Standing Counsel for the Respondent Nos. 1,2 and 3 and perused the record. The counsel for the Respondent No.4 is not present even in the revised call.

The petitioner is working as Assistant Teacher in Primary School Nagla Dhanu, District Etah. The petitioner met with an accident in the year 2017 due to which he has suffered 70% disability. The disability suffered by the petitioner is hampering him from discharging his duty, and on account of this hardship, petitioner has submitted representation dated 2.6.2019 to the Respondent No.3 Secretary, Uttar Pradesh Basic Shiksha Parishad, Allahabad with a request that he may be posted to his home town i.e. District-Mainpuri.

The grievance of the petitioner is that Respondent No.3 has not paid any heed to his representation.

Per contra, learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and Respondent No.3 may consider the grievance of the petitioner in case, he approaches respondent no.3 with a proper representation.

Considering the facts and circumstances of the case, without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with a direction to the petitioner to file a fresh representation before the respondent no.3-Secretary, Uttar Pradesh Basic Shiksha Parishad, Allahabad raising all his grievances within a period of two weeks from today. In case any such representation is filed by the petitioner, the respondent no.3 shall consider and decide the same by reasoned and speaker order within a period of three months thereafter.

With the aforesaid observations, the writ petition is disposed of.
