Heard learned counsel for the petitioner, learned Standing Counsel for respondent nos.1, 3 and 4, and Sri D.K. Singh, Advocate holding brief of Sri Neeraj Rai, for respondent no.2.
The petitioner claims to be selected on the post of Principal in a selection held by U.P. Secondary Education Service Selection Board. The name of petitioner appears at serial no.3 in the select list.
According to the petitioner, two candidates above him in the select list have not joined, and consequently, petitioner submitted a representation to the Joint Director of Education, Kanpur Region, Kanpur-respondent no.3 for being appointed on the post of Principal. On the said representation of the petitioner, respondent no.3 by order dated 27.03.2019 directed the District Inspector of Schools-respondent no.4 to take appropriate decision in the matter.
The grievance of the petitioner is that pursuant to the order of the Joint Director of Education dated 27.03.2019, respondent no.4 has not taken any decision.
Considering the facts and circumstances of the case, without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with a direction to respondent no.4-District Inspector of Schools to take decision afresh in accordance with law pursuant to the letter of respondent no.3-Joint Director of Education dated 27.03.2019, Annexure 6 to the writ petition, within a period of two months from the date of production of certified copy of this order.
