Called in revise. None appeared to press this revision. In the circumstances, I myself have perused the record.

This criminal revision under Section 397/401 Cr.P.C., has been filed aggrieved by the judgments and orders dated 26.09.1989 and 30.03.1990. The Judicial Magistrate II, Bareilly vide judgment and order dated 26.09.1989 passed in Criminal Case no.669 of 1986 convicted and sentenced revisionist to undergo six months rigorous imprisonment for offence 409 IPC with fine Rs.500/- and to undergo six months rigorous imprisonment with fine Rs.500/under Section 467 IPC and further to undergo three months imprisonment in case of default in payment of fine. Thereagainst, revisionist preferred Criminal Appeal No.184 of 1989 before Court of Additional Sessions Judge III, Bareilly (hereinafter referred to as “Appellate Court”) and Appellate Court while dismissing appeal vide judgment and order dated 30.03.1990 confirmed order of conviction passed by Trial Court except modified conviction recorded by Court below under Section 409 IPC and altered to Section 408 IPC. Being aggrieved the revisionist preferred present revision.

Having gone through the record, I do not find any manifest error or otherwise illegality, procedural or otherwise, so as to justify interference in criminal revision.

Dismissed. Interim order, if any, stands vacated.

The accused, Hargyan Singh is on bail. His bail bond and surety bond are cancelled. The Chief Judicial Magistrate concerned shall cause him to be arrested and lodged in jail to serve out the sentence passed against him. The compliance shall be prepared within two months.

Certify this judgment to the lower Court immediately.
