This appeal has been filed by Vachan Singh, Ratan Singh and Bohar Singh against the judgment and order dated 15.11.1991 passed by Fourth Additional Sessions Judge, Bijnor in S.T. No.291 of 1989.
As no one had appeared on behalf of the appellants to press the appeal and the counsel had made a statement that despite repeated letters the appellants have not responded, on 02.08.2019, bailable warrants were issued to the appellants, fixing 09th September, 2019.
Pursuant to the order dated 02.08.2019, the office has placed the report of the Chief Judicial Magistrate, Bijnor dated 29.08.2019 in which it is stated that upon inquiry it was discovered that all the three appellants have died several years ago. The report is accompanied by necessary documents as also statement of witnesses who have deposed about the death of the appellants.
In view of the above, the appeal stands abated.
