Although learned counsel was granted time to file an affidavit to explain special circumstances in light of the judgment rendered in Vinod Kumar Vs. State of U.P. [Criminal Misc. Bail Application No. 53729 of 2019 decided on 6 December 2019]., the affidavit which has been tendered today fails to establish any special circumstance which may warrant the instant application to be entertained by this Court.
Accordingly while this application shall stand dismissed , it is clarified that this order will not preclude the applicant from approaching the Sessions Court as otherwise provided under Section 438 Cr.P.C.
