Learned counsel for applicant contended that applicant is not named in F.I.R. which was lodged by one Narrottam Singh on 1.7.2018 at 11.00 a.m. as a report about finding dead body of a lady in a boring pit, by the side of road; that inquest report and autopsy report of deceased were prepared as of an unknown person and upon autopsy on 2.7.2018 the Doctor opined that death has taken place about 1 1/2 day back due to asphyxia as a result of strangulation; that on 5.7.2018 statement of Raju was recorded identifying the deceased from her photo, as Smt. Rubi wife of Chinu having got married with Chinu on 21.6.2018 was seen in his house on 6.7.2018 and the statements of witnesses Vijendra Pal Singh and Amit Pal were recorded to the effect that deceased was not willing to live with Chinu upon which Satendra, the relative of Chinu and Munni Devi, Bua of Chinu tried to convince her and upon her refusal they as well as applicant and Chinu were seen forcibly taking her from roof by stair to courtyard where they all strangulated her with scarf; that statement of above witnesses are not admissible in evidence; that in any case the above witnesses could not have seen in the courtyard, from their roof; that coaccused Satendra and Girish Chandra with identical role have been granted bail by another Bench of this Court as well as by this Court vide orders dated 21.12.2018 and 7.1.2019 passed in Criminal Misc. Bail Application Nos.49347 of 2018 and 42521 of 2018, copies of which have been produced for perusal and are taken on record; that applicant has no criminal history; that applicant undertakes that she will not misuse liberty of bail; that applicant is in custody since 13.09.2018.
