Learned counsel for the applicant contended that applicant is not named in F.I.R. and has been falsely implicated by way of concocted story brought through improvements during investigation; that as per averments made in F.I.R., applicant is cousin brother of deceased and allegedly left with deceased in noon of 9.4.2018 and on 10.4.2018 in the morning dead body of his cousin brother Pawan Kumar @ Ashu Pandey was found in canal near village culvert; that death of deceased has been found due to asphyxia as a result of ante mortem strangulation; that applicant was arrested with co-accused persons on 17.4.2018 with recovery of two stolen motorcycles and his confessional statement was recorded in police custody, which is not admissible in evidence; that subsequent to arrest of applicant, first informant in his additional statement under section 161 Cr.P.C. has introduced an absolutely false and concocted story that applicant and his associates along with deceased had stolen two motorcycles and over a dispute with regard to distribution of booty (profit) upon catching hold by co-accused Dharmendra @ Kariya and Rithik, he was strangulated to death by applicant; that applicant did not make any theft of motorcycles with deceased and neither any dispute did take place between applicant and deceased nor applicant strangulated deceased to death; that co-accused Rithik was declared juvenile and granted bail by Juvenile Justice Board and co-accused Dharmendra Yadav @ Kariya has been granted bail by this Court vide order dated 9.1.2019 passed in Criminal Misc. Bail Application No.139 of 2019, copy at Annexure No.8; that applicant has explained his history in supplementary affidavit and has been granted bail in one theft case, wherein he was falsely implicated; that applicant is not a previous convict,
