Learned counsel for applicant contended that applicant has been falsely implicated in F.I.R. lodged with inordinate delay of 4 days from incident; that according to prosecution story Vishambar Yadav, husband of first informant had gone to see his sister in Sohana (Haryana) and while returning by bus on 24.12.2017, on way he was taking meal at Shivani Hotel near Tappal Inter exchange he called his wife and told her that he has called his friend Arvind and Navin, and is going with applicant and coaccused persons in their SCORPIO Car for taking payment of Rs.80,000/- due from them, and also mentioned that accused persons named in F.I.R, are with him in SCORPIO Car but after 8.00 p.m. his mobile phone reported to be switched off and she suspects kidnapping and murder of her husband by named accused persons; that dead body of deceased was recovered from the Canal near Kuagaon, upon information given by some one on number 100, and upon autopsy of decomposed body his death was opined due to shock and hemorrhage, as a result of ante-mortem injury about 3 - 4 weeks ago; that in statements of alleged eye witnesses Arvind and Navin applicant has been assigned with role of fetching deceased in his SCORPIO Car along with co-accused persons and there is no incriminating evidence against applicant; that case is based on circumstantial evidence and there is no incriminating evidence against applicant; that recovery of iron rod at the pointing of applicant from open public place, inside bushes has been falsely planted of which there is no independent witness; that confessional statement of applicant in police custody is not admissible in evidence; that role of applicant is identical to co-accused Gyanedra @ Sonu and Rakesh; that co-accused Rinku, Rajendra whose names came in light during investigation as well as coaccused Gyanendra @ Sonu and Rakesh who were named in F.I.R. have also been granted bail by other Benches of this Court vide orders dated 13.11.2018, 13.11.2018, 30.11.2018 and 29.1.2019, passed in Criminal Misc. Bail Application Nos.40086 of 2018, 40090 of 2018, 44805 of 2018 and 24080 of 2018, copies of which have been produced for perusal and are taken on record; that applicant has explained his criminal history in paragraph 3 of the supplementary affidavit; that applicant undertakes that he will not misuse liberty of bail; that applicant is in
